All services and information made available to users by Buduchnist Credit Union Limited, carrying on business as BCU Financial (“BCU Financial”), and its affiliates on the following BCU Financial website are covered by these Terms of Use, unless otherwise provided in additional terms of use specific to certain services.

If you decide to use the BCU Financial website – including but not limited to BCU Financial website and BCU Link website – you accept and agree to be bound by and comply with the following terms of use. If you do not agree with the terms and conditions below, do not enroll for, access or use the BCU Financial website, or any pages contained in the BCU Financial website.
As a user of the BCU Financial website, you have to make sure you review the terms and conditions applying specifically to certain services provided on the BCU Financial website as they may contain variations to what is provided in these Terms of Use and create additional obligations for you.
DESCRIPTION OF SERVICES
BCU Financial currently provides users with a wide selection of online services through its website (hereinafter collectively referred to as the “Service” or the “Services”) to which these Terms of Use apply.
Unless otherwise specified, any new feature that enhances or augments one or more existing Services, or any new Service launched by BCU Financial, will be subject to these Terms of Use.
You alone are responsible for paying the costs associated with the use of the Service, such as Internet connection charges or fees charged for connecting to networks that provide access to Internet content. As well, you are responsible for acquiring any equipment needed for such connections.
IDENTIFICATION AND PASSWORD
You are not required to identify yourself when making use of the Services, except when such identifying information is required to access the BCU Financial website’s transactional tools, including but not limited to BCU Link, or credit card application forms, including but not limited to those used by Collabria Financial Services Inc. (Collabria).
The personal information Collabria Financial Services Inc. collects from you on our online credit card application depends on the product or service you requested, and is collected by Collabria in order to make a credit decision and, if approved, to administer your credit card account. Collabria is also required by law to obtain, verify and record information that identifies each person who opens an account. Because of these requirements, they may ask you to provide any of the following:
- Personal information that will be used to identify and validate your identity and, if approved, to administer your credit card account;
- Employment information;
- Income; and
- Any other financial information that may be required to perform the credit adjudication process.
GENERAL TERMS
Your access to and use of all the services and products of BCU Financial and its affiliated businesses described in the website are governed primarily by the terms and conditions of the relevant paper agreements you have physically signed at your BCU Financial Branch, as well as specific electronic agreements you have signed electronically.
For traditional deposit, withdrawal, overdraft protection, and chequing services, as well as Automated Teller Machine (ATM) access, we refer you to your “Member Account Agreement” for a more thorough explanation of our respective responsibilities. For Collabria Credit Card services, we refer you to the Collabria Financial Services Inc. Terms and Conditions. For loans and mortgages, we refer you to the various forms of agreement used to document your borrowing transactions. For telephone, web-banking, and mobile-banking access, we refer you to the “Internet and Telephone Banking Service Agreement.”
The terms and conditions of these other Agreements and any other conditions or agreements which now or may in the future exist between you and BCU Financial or its affiliates regarding any Accounts or Services shall remain in full force and effect and shall apply to the relevant product or service you obtain from BCU, except as expressly modified or supplemented by these Terms of Use in order to take into consideration the additional factor of your use of the website to access the product or service. In the event of an irreconcilable conflict, the terms and conditions of these other Agreements shall supersede the Terms of Use for this website.
We reserve the right to change the information, material and content found in the pages of this site, including these Terms of Use, at any time without notice, by simply updating this site. You agree to review these Terms periodically, and by your continued use of this site you will be deemed to have agreed to the changes.
Our Respective Responsibilities & Limitation of Liability
We will do our best to ensure that you can use the BCU Financial website and complete the transactions that can be done through the site safely and securely. Protecting the security of your funds, and the privacy and confidentiality of your personal information stored within the web server hosting the BCU Financial website and our own computer system, is an obligation we take very seriously. If fraudulent activity occurs on your accounts because of a breach in computer security, we will restore your account balances to what they should be, as long as you are not responsible in any way for the breach of security. In other words, we expect you to do your own part in preventing fraud, by, for example, keeping your password secret from others and taking other reasonable steps to prevent unauthorized access to your account balances.
Although we do our best to make sure the BCU Financial website is accessible, functioning properly, and contains accurate and up-to-date information, we are supplying it on an “as is” basis, without warranty of any kind, either express or implied. We cannot and do not promise that the site will always be available to meet your needs, that access will never be uninterrupted, that there will never be delays, failures, errors or omissions or loss of transmitted information, or that the software we use will be compatible with your computer system. Furthermore, it is your sole responsibility to adequately protect and backup your data and/or equipment and to take reasonable and appropriate precautions to scan for computer viruses or other destructive properties on your own system.
To the fullest extent permitted by law, in no event will BCU Financial be liable for any damages, including, without limitation, direct or indirect, special, incidental or consequential damages, losses or expenses arising in conjunction with the BCU Financial website or use thereof or inability to use the BCU website by any party, or in conjunction with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if BCU Financial, or representatives thereof, are advised of the possibility of such damages, losses or expenses. BCU Financial is also not liable for such damages following unauthorized access to the BCU Financial Website by a user or resulting from the actions or conduct of third parties in the course of using the BCU Financial website.
We must also warn you that unencrypted e-mail communications over the Internet are not considered to be a secure form of communication. We strongly recommend that you do not send personal or financial information to us using unencrypted e-mail.
More secure means of communicating with BCU Financial will be available for members who use BCU Link Internet Banking Service.
Notwithstanding this recommendation, we do not accept liability or responsibility for your personal or financial information becoming public through no fault of our own, by way of accident or fraud on the part of third parties.
If you do communicate with us by means of e-mail, we will assume, unless you advise us otherwise, that you consent to our using the information you have sent to us, including your e-mail address, for the purpose of developing and sending an appropriate response to your communication, and disclosing it to such other advisory parties as we deem appropriate for that purpose.
BCU Financial Products and Services are Not Offered or Available to Everyone
It is important for you to understand that not all of the products and services listed and/or described on the BCU Financial website and the information found therein, is offered to or available to every member of the general public. The information on the BCU Financial website is not to be construed as an offer or solicitation to buy or sell any currency, investment fund or other product, service or information to anyone in any jurisdiction in which an offer or solicitation is not authorized or cannot lawfully be made, or to any person or entity to which it is unlawful to make an offer.
Only individuals or entities that qualify for membership in BCU Financial under its By-laws, and who are in fact admitted to membership, are eligible to purchase the products and services described in the pages of the BCU Financial website, and make use of the information contained therein.

BCU Financial and/or its affiliates reserve the right to remove or relocate any content made available as part of the Services. This may be done for any reason.
BCU Financial may terminate your access to the Services in whole or in part in accordance with the terms and conditions applying to such Service, without advance notice of any kind. BCU also reserves the right, at any time, to de-activate or delete with immediate effect any folder or any file within a folder, and/or to prohibit future access to such files or to any Service. In no event will BCU be liable to you or to any third party for the termination of your access to any Service or BCU websites.
BCU Financial Does Not Provide Advice that is Specific to You
All non-customized and generic financial information as well as the various product features and services posted on the BCU Financial website are provided for information only. This information originates from a variety of sources and is updated on a regular basis. Jurisdiction for Disputes
BCU websites are managed by Buduchnist Credit Union Limited, carrying on business as BCU Financial, from its office in Toronto, Ontario. Its operation and these Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable laws of Canada, without regard for any principles of conflict of laws operable in Ontario. All disputes, controversies or claims arising out of or in connection with the site shall be submitted to and be subject to the jurisdiction of the courts of the Province of Ontario. You agree that you submit and attorn to the jurisdiction of the courts of the Province of Ontario to finally rule on any suit, action, or proceeding arising out of or in connection with this site.
